Terms of Membership

[Clause 1] General Provisions
  1. Japan Bus Online (hereinafter referred to as "the Service") is a website operated by Kobo Co., Ltd. (hereinafter referred to as "we," "us," or "our") that provides various services for the purposes of reservation, payment, and the like for highway buses, scheduled sightseeing buses, and trains.
  2. The Service can be used by users who have registered as members (hereinafter referred to as "Members") and by users who use the Service without registering as Members (hereinafter referred to as "Guest Users"). No fees are charged for registering as a Member or maintaining membership.
  3. Although the Service is operated by us, users transact directly with the bus companies that operate the highway and sightseeing buses and the train companies that operate the trains by submitting requests directly to said companies via the Service.
    Moreover, the credit card and various code-based payments and refunds provided through the Service are conducted by us on behalf of the bus and train companies, in our capacity as an agent for the receipt of payment funds and the processing of refunds.
  4. Please note that services such as reservation, modification, cancellation, ticketing, payment, and refunds provided through the Service are offered at the discretion of the participating bus and train companies, and thus the same services are not necessarily available across all routes.
    Further, information on the services offered can be found in the route guide displayed during the seat availability check.
  5. Regulations concerning the operation and management of highway buses, scheduled sightseeing buses, and trains are provided by the Conditions of Carriage established by the bus or train company you are using.
  6. We do not guarantee the truth or accuracy of, nor do we assume any responsibility whatsoever for damages arising from, any information displayed within the Service regarding schedules, stops, fees, vehicle amenities, or other route-specific arrangements pertaining to the operation of highway buses, scheduled sightseeing buses, or trains.
  7. The Service is available during the service hours of 5:00 a.m. to 2:00 a.m. the following day, Japan Standard Time.
    However, we may change the service hours if we deem a temporary interruption or suspension necessary in order to conduct maintenance or the like.
    The service hours are also subject to change in the event that the provision of services becomes difficult due to force majeure.
    Further, we assume no responsibility whatsoever for any losses or damages incurred by a user as a result of a temporary interruption or suspension of the Service.
[Clause 2] Member Registration
  1. You may register for free as a Member with the Service for the following purposes.
    1. Use of the Service
    2. Provision of our various services, information, etc.
  2. To register as a Member, the user must enter true and accurate data regarding him or herself. Registration by proxy is strictly prohibited.
  3. Members are responsible for managing their own passwords, such as by changing them periodically to ensure that they do not become known to others.
    If an inputted email address and password are found to match those of a registered Member, we will deem such access to have been made by the Member, and we assume no responsibility whatsoever for any damages arising from such access, even if it occurred through theft, unauthorized use, or the like by someone other than the Member.
  4. If any changes occur in your registered information, please promptly update the said information.
    We assume no responsibility whatsoever for any damages that arise due to your not updating your information.
    Moreover, even if you have updated your information, transactions requested before the update may still be processed based on the information entered before the update.
    In cases where it is necessary to notify bus companies, train companies, or the operators of various partner services of changes to your registered information that you have provided in regard to such transactions, the user must contact those entities directly.
  5. It is prohibited to register as a Member with us using an email address with which the user may not be personally identifiable.
    If an email address that is not eligible for member registration is used, the member registration will not be processed.
  6. The information submitted by users during member registration, and any information that we acquire when the Service is used, will be entered and held by us in a database that we manage.
  7. Regarding Guest Reservations
    Guest Users can use the Service without completing member registration. However, some features of the Service (purchase of mobile multi-ride tickets) cannot be used by Guest Users.
    Guest Users must enter true and accurate data when making reservations or purchases. Guest Users shall bear responsibility for managing reservation numbers issued upon completion of reservations as well as email addresses entered during the reservation process (or corresponding information).
    We assume no responsibility whatsoever for any damages arising from such information becoming known to a third party.
[Clause 3] Reservation, Modification, and Cancellation Services
  1. The Service provides functions enabling users to request reservations, modifications, and cancellations with respect to highway buses, scheduled sightseeing buses, and trains.
    When using the reservation, modification, and cancellation services provided through the Service, users transact directly with the bus and train companies that operate the highway buses, scheduled sightseeing buses, and trains by using the Service to submit requests directly to said companies.
    Therefore, we, as the operator of the Service, are not a contractual party to any reservation, modification, or cancellation carried out by the user, and we assume no liability whatsoever with regard to the use of the reservation, modification, and cancellation services.
  2. The functions provided by the reservation, modification, and cancellation services are as follows.
    1. Checking Seat Availability and Creating a Reservation: Obtaining a reservation
    2. Checking of Ticket Status: Checking reservation details and status
    3. Reservation Cancellation: Canceling an entire reservation
    4. Return Trip Cancellation: Canceling only the return trip of a round-trip reservation
    5. Reducing Passenger Count: Modifying a reservation to reduce the number of passengers
    6. Change of Boarding/Alighting Points: Changing the stops set for boarding and alighting
    7. Adding a Return Trip: Changing a reservation from one-way to round-trip
    8. Change of Service: Changing the date or departure time
    9. Change of Seat: Changing a seat
  3. If you need to make a change to your reservation that is not listed in the preceding paragraph, please either make a new reservation or contact the designated service counter of the bus or train company that you are using.
  4. During the reservation process, a tentative reservation is established upon our sending an email to the user.
    As a rule, you may not board the bus or train while the reservation remains in this status.
    Please purchase a boarding ticket either at the designated service counter of the bus or train company or via credit card.
  5. After a reservation has been made, as a safeguard against impersonation of the user, we will send a confirmation email to the email address we have on file or which was entered upon reservation.
[Clause 4] Credit Card Payment and Refund Services
  1. The Service provides a function enabling credit card payment of fares for highway buses, scheduled sightseeing buses, and trains.
    Additionally, if a user cancels a reservation for which payment was made via credit card through the Service, we will process a refund of the credit card payment.
    Credit card payments are received by us, the operator of the Service, acting as an agent on behalf of the bus and train companies participating in the Service.
    Our responsibility for credit card payments and cancellations (refunds) is limited solely to our receiving of fares as an agent as well as the refunding thereof, and we assume no other responsibility whatsoever.
  2. For credit card payments, because the user's obligation to pay arises when the payment is processed, a refund will not be issued, regardless of whether the user actually boards or the bus or train is canceled, unless the user personally cancels the reservation.
  3. Cancellation (refunding) of a credit card payment may be subject to fees such as cancellation fees, cancellation processing fees, and refund processing fees as separately stipulated by the bus or train company.
  4. Reservation cancellations and refunds are limited to the cancellation/refund period designated by the bus or train company that operates the route, and under no circumstances will a refund be issued after the scheduled departure time unless accompanied by a Certificate of Non-Boarding issued by the bus or train company that operates the route.
  5. If a bus or train is canceled due to a natural disaster or the like, a refund may be possible notwithstanding the provisions of paragraphs 3 and 4.

[Clause 5] Notifications to Users
  1. Upon completion of a member registration, the registration details will be sent by email.
    The email will contain the user's registration details.
    Users are responsible for managing their registration details to ensure that they are not revealed to a third party.
  2. Upon completion of a reservation, modification of a reservation, cancellation of a reservation, or changes made to member information, the details will be sent by email.
  3. Details will also be sent by email upon processing of a credit card payment.
  4. In case it becomes necessary to contact you due to a service suspension or the like, you may be contacted by either the bus or train company or by us via telephone or email.
[Clause 6] Handling of Personal Information
  1. Purposes of Use of Personal Information
    The Service collects personal information from users (both Members and Guest Users) for the following purposes.
    1. Provision of the Service (including reservations, payments, changes, and cancellations for highway buses, scheduled sightseeing buses, and trains, as well as emergency notifications regarding service suspensions, delays, etc.)
    2. Provision of our various services, information, etc.
  2. Please ensure the accuracy of the personal information that you provide while using the Service. Even if you make a reservation or purchase as a Guest User, the personal information that you provide will be handled in accordance with the provisions of this clause.
    Users agree to maintain the information they have registered (in the case of Members) or the information they have provided during use (in the case of Guest Users) in an up-to-date and accurate state at all times in accordance with the provisions of these Terms & Conditions.
    Moreover, except in the following cases, we will not use your personal information for purposes other than those specified, nor will we disclose or provide such information to third parties, without obtaining your prior consent.
    1. When pursuant to laws or regulations
    2. When necessary to protect a person's life, health, or property, and it would be difficult to obtain your consent
    3. When specifically necessary to improve public health or promote the sound development of children, and it would be difficult to obtain obtain your consent
    4. When it is necessary to cooperate with a national agency, a local government, or contractor thereof in the performance of duties prescribed by laws or regulations, and obtaining your consent could hinder the performance of said duties
  3. Transfer and Provision of Personal Information
    With respect to the information that we collect through the Service, we will provide and share the operationally necessary information below with the bus companies, train companies, and operators of various partner services.
    "Bus companies, train companies, and operators of various partner services" refers to bus and train companies that operate transportation services; bus and train companies that jointly operate applicable routes; companies contracted by bus or train companies to provide reservation and ticketing services; and insurance providers.
    The information provided consists of the person's name, telephone number, gender, and information concerning reservations and ticketing.
  4. Voluntary Nature of Your Provision of Personal Information
    Your provision of the personal information that we collect is entirely voluntary.
    However, if you do not provide such information, you will not be able to use our services.
  5. Requests for Notification of Purpose of Use, Disclosure, Correction, Suspension of Use, etc., of Personal Information
    You can contact us with inquiries and requests about your personal information with regard to the following matters.
    1. Whether or not we possess your personal information
    2. If the purposes of use for the personal information that we possess are inadequate
    3. If we do possess your personal information, the details thereof
    4. Additions, corrections, or deletions in case there are errors in the personal information of yours that we possess
    5. Suspension of use or of provision to third parties or erasure of the personal information of yours that we possess

    We will not use credit card information for any purpose other than processing credit card payments for bus and train tickets.

    The period for which we are obligated to retain order information, starting when the customer makes a credit card payment
[Clause 8] User Responsibilities
  1. Members themselves shall bear responsibility for managing their own email addresses and passwords to prevent unauthorized use.
    Even if these credentials are used by someone other than the Member, whether through theft, unauthorized use, or other circumstances, we assume no responsibility whatsoever for any damages arising therefrom.
    Guest Users shall bear personal responsibility for managing the reservation number issued upon completion of a reservation, the contact information (email address, etc.) entered at the time of reservation, and all reservation information associated with such information.
    We assume no responsibility whatsoever for any unauthorized access or disputes arising from such information becoming known to a third party.
    You must enter an email address and password of your own choosing.
  2. We assume no responsibility whatsoever for any unauthorized access or disputes arising from a user's failure to properly manage their credentials. Users themselves are responsible, at their own expense, for setting up an appropriate operating environment (hardware, software, etc.) that will enable them to use the Service.
  3. We assume no responsibility whatsoever for any problems arising in the Service or any consequences resulting therefrom due to a user's equipment or facilities.
    Users shall comply with these Terms & Conditions, as well as with general internet etiquette, ethical standards, and technical protocols.
    In the event that a user engages in conduct that violates these Terms & Conditions, commits unauthorized or unlawful acts, or if any of the circumstances specified in [Clause 11] otherwise applies, we may, in accordance with said clause, take measures such as suspending their use of the Service, revoking their membership, or canceling their reservations, and in the event that we incur damages, we reserve the right to claim compensation from the said user.
  4. Users are responsible for any communication expenses incurred through the use of the Service.
[Clause 9] Our Responsibilities
  1. While we will negotiate in good faith and strive to resolve any problems or disputes arising from the Service or its ancillary services, we assume no liability and make no guarantees whatsoever in connection therewith.
  2. We assume no responsibility whatsoever regarding whether information entered in a reservation and transmitted by a user successfully reaches our computers or whether the reservation information that we receive is identical to the information transmitted by the user.
[Clause 10] Changes to Terms & Conditions and Changes to the Service
  1. The Terms & Conditions may be changed without the consent of the user.
  2. We may change the content of the Service without giving prior notice to users.
    After any change to the content of the Service, only the content following the change will be deemed valid.
    We assume no responsibility whatsoever for any losses or damages resulting from changes to the content of any service.
[Clause 11] Suspension of Use of Service, Revocation of Membership, and Cancellation of Reservations
  1. Suspension of Use and Other Measures by Us: If we determine that a user (whether a Member or a Guest User) is subject to any of the grounds specified in the following paragraph, we may, without prior notice or demand, temporarily suspend the user's access to all or part of the Service or take any of the following measures.
    For Members, membership may be revoked (forced withdrawal).
    For Guest Users, any reservations already made may be canceled in whole or in part, or future use of the Service may be denied.
  2. Grounds for Suspension of Use (Prohibited Acts): The measures in the preceding paragraph shall be applied in case of any of the following grounds.
    If the user violates these Terms & Conditions or any other rules.
    If the information entered during member registration or the reservation process contains misrepresentations, errors, or omissions.
    If it is discovered that the user has previously had their membership revoked or their service usage suspended due to a violation of these Terms & Conditions or the like.
    If the credit card or other payment method provided by the user has been suspended or rendered invalid, or if the credit card has been used fraudulently.
    If the user delays the fulfillment of any obligation to pay fees or refuses to make payments.
    If the user impedes the operation of the Service by any means whatsoever.
    If the user commits any act that causes or is likely to cause inconvenience, loss, or damage to us, other users, bus companies, train companies, or third parties.
    If the user commits any act that is contrary to public order and morality; any act that violates laws or regulations; or any act that is likely to have such effects.
    If the user is deemed to be an antisocial force or the like; or if we determine that the user has had any relations or involvement with antisocial forces or the like.
    If we otherwise determine that the user is unsuitable.
  3. Disposition Following Measures Above
    We shall bear no liability whatsoever for any damages incurred by the user as a result of any measures taken pursuant to the preceding paragraph.
    Any member whose membership has been revoked shall, as of the time of such revocation, forfeit all rights pertaining to the use of the Service and shall be prohibited from re-registering as a member.
    In the event that we suffer damages as a result of a user's violation of these Terms & Conditions, we reserve the right to claim compensation from said user, independent of any other measures specified in this paragraph.
